Terms and Conditions Amendments due to Coronavirus COVID-19

We have temporarily amended our standard Booking conditions to give you, the traveler, more flexibility as you evaluate and decide on booking an experience. We are working closely with our international and local network to adapt our health and safety standards preparing for the new realities of global mobility and local travel, we will continue to adapt our methods and policies to give you as always a top quality experience.

As we move through various stages of this pandemic crisis caring ourselves and those we serve is paramount, here is what you can expect from our upcoming experiences:

  • Reschedule by Aire Libre Running

We have posted on our website alternate dates for every experience in case any of them need to be rescheduled for any reason outside our control. If an experience gets postponed, you will automatically be transferred to this alternate date. If you are unable to attend you have a number of options available:

  • If for any force majeure event we must postpone or cancel your running experience, you may request a full refund, no questions asked, at least 30 days before the experience start date.
  • Force majeure policy does not address circumstances related to the coronavirus (COVID-19) pandemic
  • If travel regulations due to the pandemic force us to cancel or postpone the experience, you may request a partial refund equal to the total amount of your booking less a 30% fee related to non-refundable expenses.
  • Your booking is safe with us no matter what. In case of cancellation or postponement, you may easily transfer your booking credit to any other experience free of charge and without expiration date up to two times for free, up to 60 days before departure.
  • Any change in value above the original order will be charged, any value below will be credited.
  • Keep your experience payments as credit (never expires) to apply to any future experience or Aire Libre merchandise products.
  • Put on hold or delay your balance payment schedule to give you more flexibility and extended installment deadlines.
  • Rebook under a different name, free of charges.

Booking terms & conditions

These are the Terms and Conditions that will apply to your booking

Please read them carefully as you will be bound by them.

These Terms shall constitute the entire agreement between the Hijos Del Sendero S.A. de C.V. (also referred to as Aire Libre Running) and the Client relating to the subject matter herein, and shall constitute a binding agreement. There is no verbal or written; representation, warranty, prior agreement, or description of services, other than as expressed herein.

The contract and booking is made with, and services will be provided by, Aire Libre Running. By booking a trip, you agree to be bound by these Terms and Conditions that govern the relationship, the cancellation policy and limitations of liability. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

Booking an Aire Libre Running experience & the contract

All persons wishing to make a booking have carefully read and understand the Terms and Conditions that follow. By making a booking with Aire Libre Running, you accept on behalf of yourself and all those named on the booking, including minor(s) and/or person(s) under a disability to be bound by these Terms and Conditions. A booking is accepted and becomes definite only from the date when Aire Libre Running, sends a confirmation email. It is at this point that a contract between Aire Libre Running, and the Client comes into existence. Before your booking is confirmed and a contract comes into force, Aire Libre Running, reserves the right to increase or decrease trip prices. Aire Libre Running, reserves the right to decline any booking at their discretion. The person or persons named on the booking are hereafter referred to as the “Client”. All bookings are made with Aire Libre Running, which sells the tours described in this website.

An Aire Libre Running team member will contact you within 72 hours, regarding your completed registration to confirm your participation in your selected trip. Confirmation of your participation does not necessarily mean that your trip is confirmed to run. Aire Libre Running encourages you to refrain from purchasing non-refundable travel until you receive an email confirmation from the Aire Libre Running staff. In order for our experiences to take place we have a minimum of 8 participants.

Deposits & Cancellations for Retreats and Getaways

You may book a getaway or a retreat with a deposit (down payment) until 1 month prior to the retreat start date, after which full payment is required to secure your spot (if any are still available).

Our retreats typically fill three or more months in advance.

The remaining balance of your retreat payment is due 30 days before the retreat begins. We will notify you of the balance due date after your deposit has been processed.

If the final balance is not received by the due date, then your booking cannot be guaranteed and Aire Libre Running reserves the right to cancel your booking and forfeit your deposit.

Deposits & Cancellations for Local Escapes

You may book a local escape with a deposit (down payment) until 1 week prior to the start date, after which an active payment plan will be required to secure your spot (if any are still available).

Our local escapes typically fill four or three weeks in advance.

The remaining balance of your local escape payment may vary and depend on the specific trip you have chosen. We will notify you of the balance due after your deposit has been processed.

Aire Libre Running reserves the right to ask you to pay off the due balance before the trip starts if you. have defaulted on your payment plan.

Refund / Cancellation policies.

We understand that unexpected events can arise that can affect your plans. We strongly recommend all our retreat guests purchase travel insurance to protect their purchase.

Booking early ensures you a spot in a retreat, many of which sell out far in advance.

If the customer cancels: If you choose to cancel a departure the following terms will apply:

For Retreats and Getaways:

  • To be entitled to a full refund, your cancellation needs to be requested at least 180 days before the experience start date.
  • To be entitled to a partial refund equal to your deposit, your cancellation needs to be requested at least 120 days before the experience start date. If you paid the total cost in a single exhibition, the refund will be equal to 10%.
  • 90 days before the retreat start date you may transfer your credit to a different retreat or getaway to be used within a maximum of 360 days after your original purchase date. There is a $100 USD administration per person fee associated with making this change. After you transfer your credit, it becomes non-refundable.
  • All retreats and getaways become fully non-refundable 119 days before the experience begins.
  • You are subject to a refund less any processing fees, cancellation fees and nonrefundable deposits at Aire Libre Running discretion, if there is a safety or health hazard that would adversely affect your participation or others involved. The amount of any refund will depend on the nature of the issue.

Arriving late or leaving an Experience in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of an Experience.

For Local Escapes:

  • To be entitled to a full refund, your cancellation needs to be requested at least 90 days before the experience start date.
  • 30 days before the local escape start date you may transfer your credit to a different experience to be used by Dec 31, 2023. There is a $40 USD administration fee per person associated with making this change. After you transfer your credit, it becomes non-refundable.
  • You can receive a partial refund equal to your deposit payment if you cancel within 60 days before the experience start date.
  • All local escapes become fully non-refundable 59 days before the local escape begins.
  • You are subject to a refund less any processing fees, cancellation fees and nonrefundable deposits at Aire Libre Running discretion, if there is a safety or health hazard that would adversely affect your participation or others involved. The amount of any refund will depend on the nature of the issue.

Arriving late or leaving an Experience in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of an Experience.

Balance Transfer

  • Full and partial retreat and getaway retreat payments can be transferred to another trip retreat taking place before Dec 31, 2023, if you notify us 90 days or more before the retreat or getaway begins, and 30 days or more before any local escape begins. For this reason, we recommend you purchase travel insurance.
  • For retreats and getaways there is a $100 USD deposit transfer fee associated with making this change and a $40 USD deposit transfer fee for local escapes, that avoids incurring the cancellation fee.
  • You may also transfer the balance to a friend if you let us know 30 days or more in advance.
  • You may only transfer your retreat deposit one time.

Pricing & Fees

All retreat prices are quoted and payable in USD.

Aire Libre Running is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency.

Medical conditions & special requirements

The Client must fill out Aire Libre Running medical form. The Client must inform Aire Libre Running of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel and/or any medical condition. Failure to notify Aire Libre Running may result in the Client being refused travel. Failure to notify Aire Libre Running, of any such condition that results in cancellation will have full cancellation fees to the Client. Some trips may be unsuitable for Clients due to age, mobility, disability, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking. Aire Libre Running, may refuse to carry pregnant women over 24 weeks or Clients with certain conditions. Aire Libre Running, is not required to provide any special facilities unless it has agreed to do so in writing. Aire Libre Running, will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore Aire Libre Running, is not liable for not providing these requests. Medical facilities vary from country to country and Aire Libre Running, makes no representations and gives no warranties in relation to the standard of such treatment.

Medical Authorization and Coverage

In the event the participant becomes sufficiently incapacitated as to be unable to direct his or her own care, there is no one on the Experience who can direct participant’s care, and Aire Libre Running is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for an Experience, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a duly licensed physician deemed competent to render the necessary care. In addition, the participant certifies that they have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.

ACCEPTANCE OF BOOKING & FINAL PAYMENTS

Acceptance of Booking

Aire Libre Running, will confirm acceptance of the Client’s booking via email. Please ensure Aire Libre Running, is on your contact list so our emails don’t go to your junk folder!

In case of cancellation by Aire Libre Running

Aire Libre Running, reserves the right to cancel any trip for any reason, but will not cancel a tour less than 30 days before departure except for unusual or unforeseen circumstances outside Aire Libre’s control. When a tour is canceled by Aire Libre Running, before the agreed date of departure for any reason other than the fault of the Client, the Client can either:

  • In a timeframe longer than 4 months before the set departure date, for any reason other than the fault of the Client, the Client can either transfer their deposit (never expires) to another experience or receive a full refund.
  • If the experience is cancelled within a 4 month period previous to the departure date, Aire Libre Running, you can either transfer your deposit (never expires) to another experience or ask for a refund less any processing fees, cancellation fees and nonrefundable deposits we paid to suppliers and partners on your behalf.
  • You may also transfer the balance to a friend if you let us know 30 days in advance.
  • You may transfer your balance to a different experience destination up to two times for free, up to 60 days before departure. Any change in value above the original order will be charged, any value below will be credited.

Aire Libre Running is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. If the Client is offered a transfer but requests an alternate tour of a higher value than that originally booked, then the Client must pay the difference in price. Where after departure a significant element of the trip contracted for cannot be provided, Aire Libre Running, will make suitable alternative arrangements for the continuation of the trip. If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, Aire Libre Running, will provide the Client a refund of unused tour portions. If Aire Libre Running cancels the Experience in progress the participants will receive a prorated refund based on the number of days not completed on the Experience. If a participant elects to leave an Experience in progress of their own volition, the participant will not receive any type of refund. Where a significant alteration or cancellation occurs which is not due to Force Majeure or other circumstances beyond the Aire Libre´’s control, Aire Libre Running, will in some circumstances offer compensation. Significant alterations do not include the substitution of a transportation method, modification of itineraries, change in hotel accommodation or meal offering.

If Aire Libre Running or the local tour operator cancel the Experience in progress and the participant elects not to immediately return to his/her original point of departure for the Experience, or if the participant elects to leave an Experience in progress of their own volition, the participant acknowledges and agrees that: the participant shall be solely responsible for his/her travel plans once he/she departs the Experience, neither Aire Libre Running or the local tour operator shall have any responsibility for or control over the participant’s safety or activities once he/she departs the Experience, and the participant releases and holds harmless Aire Libre Running and the Tour Operator, from any and all costs, liability, loss, damage, injury, or death that may arise out of the participant’s decision to not return to his/her original point of departure from the cancelled Experience in progress. Except as outlined above when Aire Libre Running cancels an Experience, Aire Libre Running and the Tour Operator have no responsibility for any expenses, including any non-refundable expenses, incurred by the participants in preparing for a cancelled Experience or for any additional arrangements should the participants embark prior to the scheduled group departure date.

Optional Excursions: If a participant elects to participate in any additional activity or excursion that is not arranged or led by Aire Libre Running or the Tour Operator, neither Aire Libre Running nor the Tour Operator shall have any responsibility for or control over the participant’s safety or well-being, and the participant releases and holds harmless Aire Libre Running and the Tour Operator from any and all costs, liability, loss, damage, injury, or death arising from the participant’s decision to participate in such activity or excursion.

Airfare

All Aire Libre Run trips do not include domestic or international airfare. Aire Libre Running, strongly recommends you wait until the trip is confirmed to run before booking airfare or making any non-refundable travel arrangements.

Travel & health insurance

Aire Libre Running highly recommends Clients obtain travel medical insurance with a minimum medical coverage of $100,000 USD while traveling with Aire Libre Running. This insurance must cover personal injury and emergency medical expenses including, but not limited to, helicopter evacuation, air ambulance and repatriation.

It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client during travel. Aire Libre Running, shall have no liability for loss, theft of or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the client in public lounges or other public areas, whether on board a train, bus, or other mode of transportation, publicly owned or operated by Aire Libre Running, or elsewhere, are not reimbursable. Losses due to ordinary wear and tear, and other acts of God are not reimbursable. Aire Libre Running, cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Aire Libre Running, such as hotels, huts, expedition vehicles, or any other mode of transportation.

The Client acknowledges that the cost of Aire Libre Running, retreats do not include insurance and that the Client has been advised to obtain separate coverage at an additional cost. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken.

Evacuation procedures and costs

Aire Libre Running, experience leaders, local guides or other representatives decisions will at all times be final on all matters likely to affect the safety and well-being of the trip. We reserve the right to prohibit any traveler from continuing on a trip with no right of refund if, in our opinion, that traveler’s actions pose a threat to the safety of others, to the wildlife, themselves, or if the traveler’s actions and/or behaviors are harming the enjoyment of the trip for others.

Evacuations costs are to be covered by the person being evacuated.

Travel documents

Valid Passport: The Client must be in possession of a valid passport required for entry, departure and travel to retreat destinations (passport must be valid 6 months past the return date), all visas, permits and certificates including vaccination certificates (if required), insurance policies, etc. are required for the whole of the journey. The Client accepts full responsibility for obtaining all such documents, visas and permits prior to the start of the retreat and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by Aire Libre Running, regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client and Aire Libre Running, is not responsible for any errors or omissions as to the information provided by third parties such as the appropriate governmental authorities.

Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility.

Retreat Details: To expedite the obtaining of travel documents and flight bookings please note that all international trip-related documents such as Retreat Planning Guides will be sent via email once the trip is confirmed to run. Aire Libre Running, will aim to confirm trips within a reasonable timeframe.

Claims & complaints

If a Client has a complaint against Aire Libre Running,, the Client must first inform the Retreat Leader or guide at the earliest opportunity to allow the grievance to be rectified. If satisfaction is not reached, contact the Aire Libre Chief of Operations whilst on retreat so that Aire Libre Running, is provided the opportunity to rectify the matter. Failure to indicate dissatisfaction whilst on tour will result in the Client’s ability to claim compensation from Aire Libre Running, being extinguished or at least reduced. If satisfaction is still not reached through these means on retreat then any further complaint must be put in writing to Aire Libre Running, within 30 days of the end of the trip.

Client responsibility

The Client acknowledges he or she will be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in her daily life. By booking travel with Aire Libre, the Client acknowledges she has considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. The Client is solely responsible for acquainting themselves with customs, weather conditions, physical challenges, and laws in effect at each stop along the itinerary, and is encouraged to locate or make contact prior to embarkation with her local embassy or consulate at the trip destination.

Suppliers & independent contractors

Hotels, shuttle services, excursions or other elements of Aire Libre Running will be arranged by Aire Libre Running, with local suppliers who may themselves engage the services of local operators and/or sub-contractors. Aire Libre Running, will at all times endeavor to appoint reputable and competent local suppliers. The terms and conditions of the suppliers will be applicable. These may limit or exclude the liability of the supplier. The liability of Aire Libre Running, will not exceed that of any supplier. Local laws and regulations of the relevant country will be relevant in assessing the performance of the services of any supplier. Neither Aire Libre Running, nor any carrier is liable for independent contractors.

Safety & trip enjoyment

We take your safety and well-being very seriously, which is why we partner with accredited tour operators, licensed guiding companies and other trained professionals for our all of domestic and international retreats. However, you are ultimately responsible for your safety, which is why we ask all retreat participants to sign a liability waiver before departure. To avoid possibly dangerous situations, it is extremely important that you obey any rules and regulations imposed by the Aire Libre Running, Retreat Leaders and/or Local Guides and instructions given by them.

Aire Libre Running, reserves the right to prohibit any Client from continuing on a trip with no right of refund if, in our opinion, that Client’s actions pose a threat to the safety of them, others, or to the wildlife, or if that Client’s actions or behaviors are seriously jeopardizing the enjoyment of the trip for others. The decision of the Aire Libre Running, Retreat Leader or representative will at all times be final on all matters likely to affect the safety and well-being of the trip. All Clients must, at all times, strictly comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and Aire Libre Running, will not accept responsibility or liability for any Client who contravenes any laws or other regulations of any country visited.

Health & fitness

Most Aire Libre Running, trips should not be overly strenuous for people who are healthy and reasonably fit. All travelers are expected to carry their own bags, and the running, accommodation, and travel on certain programs can be very physically demanding. If you (or anyone on whose behalf you are booking) are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the trip, you must advise us of this at the time of booking. If your health or fitness changes between the time of booking and the trip departure date, you must notify the Aire Libre Running, office of these changes before the trip starts.

Photos, video and content creation

By making a booking on an Experience, the participant agrees to allow his/her likeness to be used by Aire Libre Running, Aire Libre Running-authorized third parties, and the tour operator without compensation to the participant.

In the course of participation in a Aire Libre Running, event, photos or video may be taken by participants, guides and professional photographers. These images may be used in any Aire Libre Running, materials, website, Facebook, etc., unless Clients specifically request to the photographer or in writing to Aire Libre Running,, to not use any material your image is depicted in.Otherwise, permission is granted to Aire Libre Running, to perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

Retreat itinerary changes

Aire Libre Running and its partners reserves the right to alter retreat programs and itineraries due to weather, road conditions or other circumstances. Every reasonable effort will be made to operate Experience as planned, but alterations may still occur after final itineraries are sent. These programs may be changed or cancelled at any moment due the trip to assure the safety of our clients and staff. No responsibility is accepted for losses, expenses due to delays, changes of flights or other services because of strikes, accidents, sickness, damage, negligence, weather, war, changes in schedules or other similar causes. Aire Libre Running, and its partners do not assume responsibility for accidents or deaths that can be traced to the participants’ negligence, acts of third parties or exterior circumstances such as weather, natural occurrences, ware or other similar causes.

Data protection

To ensure that tours run smoothly, Aire Libre Running, needs to use personal information (such as name, address, special needs, health conditions, dietary requirements etc.) provided by Clients to Aire Libre Running,, and also pass on such information to other outfitters/guides or suppliers involved in the operation of the trip. Aire Libre Running, will apply appropriate security measures to protect such personal data and will only pass on data that is applicable to outfitters or suppliers responsible for the tour. By completing the Aire Libre Retreat Booking Form, Clients consent to this information being transferred as required.

Liability

Aire Libre Running, is not responsible for any improper or non-performance of any services forming part of the Contract which are wholly attributable to the fault of the Client, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services to be provided under the Contract; unusual and unforeseeable circumstances beyond the control of Aire Libre Running, and/or the relevant supplier, the consequences of which could not have been avoided even if all due care had been exercised including (but not limited to) an event of force majeure; or any event which Aire Libre Running, and/or the relevant supplier could not even with all due care have foreseen or forestalled.

In the event that Aire Libre Running, is responsible for any death, injury or illness caused by the negligent acts and/or omissions of its suppliers of services which form part of the Contract then Aire Libre Running, limits its liability.

Acceptance of risk

By booking an experience, the Client acknowledges that the nature of the tour is adventurous and may involve a significant amount of personal risk. The Client hereby assumes all such risk and does hereby release Aire Libre Running, from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks which may be caused by forces of nature, illness, or by willful or criminal conduct of third parties or by terrorism. The participant further acknowledges that weather conditions may be severe, adverse and/or unpleasant and that medical services or facilities may not be readily available or accessible or consistent with standards in the United States during some or all of the time during which he/she is participating on the Expedition and that when available may not be of the quality which exists in the United States.

By booking an experience, the Client agrees Aire Libre´s RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. Please read carefully. The Client will be as well required to electronically sign the waiver of liability before departure, which will be authenticated by the participants email address, and/or by the name on the credit card used for booking.

Severability

In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason than such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.

Successors & assigns

These Terms and Conditions shall inure to the benefit of and be binding upon Aire Libre Running, and the Client and their respective heirs, legal personal representatives, successors and assigns.

The Company, Aire Libre Running, exists under, and is pursuant to, the laws of Mexico.

Applicable law

The Contract and these Terms and Conditions are subject to the laws of Mexico.

Waiver of booking conditions

These Booking Terms and Conditions may only be waived or amended by written mutual consent. When a Client completes, submits and makes the payment for booking their place for a retreat, they agree to accept all these conditions, and when the booking is accepted, Aire Libre agrees to carry out the obligations as defined therein.

Updating of terms & conditions

Aire Libre Running, reserves the right to update and/or alter these terms and conditions at any time, and it is the Client’s responsibility to be familiar with them. The latest terms and conditions may be found on Aire Libre’s website.p
